1. Introduction

Publish Tower respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have implemented a policy for responding to claims of copyright infringement on our platform. This DMCA Policy applies to all websites and digital properties under the Publish Tower umbrella.

If you believe that any content on our sites infringes upon your copyrighted work, you may submit a notification of the alleged infringement to our designated copyright agent as outlined below.

2. Submitting a DMCA Takedown Notice

To file a DMCA takedown notice, you must provide a written notification that includes the following information:

  • Identification of the copyrighted work you believe has been infringed. Please provide a description of the work, along with a link or reference to the original work, if possible.
  • Identification of the material on our website that you claim is infringing. You must include the URL(s) or specific location of the infringing material to help us locate it.
  • Your contact information, including your full name, mailing address, telephone number, and email address.
  • A statement of good faith: “I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law.”
  • A statement of accuracy: “The information in this notification is accurate, and I am either the copyright owner or authorized to act on behalf of the copyright owner.”
  • An electronic or physical signature of the person authorized to act on behalf of the copyright owner.

3. Counter-Notification Procedure

If you believe that your content was mistakenly removed or disabled due to a DMCA notice, you may file a counter-notification. Your counter-notification must include:

  • Identification of the content that was removed and the location at which it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief the content was removed as a result of a mistake or misidentification.
  • Your contact information, including your full name, mailing address, telephone number, and email address.
  • A statement consenting to the jurisdiction of the Federal District Court for your judicial district, or if you are outside the United States, to the jurisdiction of any judicial district in which Publish Tower may be found, and that you will accept service of process from the person who provided the original DMCA notice.
  • An electronic or physical signature.

Counter-notifications can be sent to the same DMCA Agent contact details provided above. Once we receive your counter-notification, we may reinstate the removed content within 10 to 14 business days unless the original complainant initiates a court action against you.

4. Repeat Infringer Policy

In compliance with the DMCA and other applicable laws, Publish Tower will terminate the accounts of users who are found to be repeat infringers in appropriate circumstances. A repeat infringer is defined as any user who has received two or more DMCA takedown notices. We reserve the right to suspend or terminate user accounts at our discretion.
